Partnership Appreciates Final Rule Partially Aligning HIPAA with Confidentiality of Patients With Substance Use Conditions Regulations

As part of the Partnership to Amend 42 CFR Part 2 ("Part 2"), ASAM appreciates the Department of Health and Human Services (HHS) and the Substance Abuse and Mental Health Services Administration's (SAMHSA) release of a final rule implementing provisions mandated by the Coronavirus Aid, Relief, and Economic Security (CARES) Act. To help address the addiction crisis, the rule will allow for more appropriate sharing of SUD patient records by promoting partial alignment between Part 2 and the Health Insurance Portability and Accountability Act (HIPAA), while maintaining critical privacy protections.
